Four Mile uranium mine held up in legal dispute

  • Miners clash on native title Sarah-Jane Tasker
  • From: The Australian
  • November 13, 2009

THE joint-venture partners in what is expected to be Australia’s next uranium mine are locked in a legal dispute over a native title agreement on the project.

Alliance Resources, a 25 per cent stakeholder in the Four Mile project in South Australia, has moved in the Supreme Court against joint-venture partner Quasar Resources, an affiliate of US-based Heathgate Resources.

Alliance is accusing Quasar and Heathgate of negotiating a native title agreement combining the Four Mile project with Heathgate’s Beverley mine.

The company said it was not involved in negotiations on the agreement and was concerned it exposed Alliance to liabilities that might apply only to the Beverley operation.

“As the native title mining agreement hasn’t been registered, a mining lease can’t be offered to the joint venture at this time, and therefore onsite construction at Four Mile can’t commence,”Alliance said………..http://www.theaustralian.com.au/business/mining-energy/miners-clash-on-native-title/story-e6frg9dx-1225797126479

SA government not protecting sanctuary against uranium pollution

Arkaroola plan ‘not strong enough’ ABC News 28 Oct 09 A Greens’ legislative councillor says a South Australian Government plan to manage mining and conservation in the Northern Flinders fails to protect the Arkaroola Wilderness Sanctuary.

The plan is a response to the discovery of illegally dumped exploration waste at Arkaroola but Mark Parnell says the response is not strong enough.

“The Government should have just made the announcement that they were not going to allow future exploration or mining anywhere in the wilderness sanctuary,” he said.

“Instead, they have produced a map for discussion that shows most of the wilderness sanctuary still available for mining and only one tiny area close to Mount Painter which is designated as off limits.”…………… The State Government draft framework is currently open for public comment. http://www.abc.net.au/news/stories/2009/10/28/2726287.htm

BHP’s uranium mine to miss deliveries

BHP Declares Force Majeure on Olympic Dam Contracts  By Brett Foley Oct. 20 (Bloomberg)– BHP Billiton Ltd. declared force majeure on some supply contracts after the closure of a shaft at Australia’s Olympic Dam, the world’s largest uranium deposit and the fourth-biggest copper lode.

The Australian company has told affected customers of the disruption to shipments, London-based spokeswoman Bronwyn Wilkinson said today in an e-mailed statement.
Force majeure is a legal clause allowing a company to miss deliveries because of circumstances beyond its control.
BHP, the world’s largest mining company, is still investigating damage caused by a mechanical failure to the hoist system at the mine’s Clark shaft two weeks ago.
